Protecting your private information is our priority.  This Privacy Policy, which is part of and incorporated into the TUTORCARE Terms of Use (“Terms”), was designed to help you understand how we collect, transmit, and store information about our users.  This Statement of Privacy applies to the website,, and governs data collection and usage.  By accepting this Privacy Policy, you expressly consent to the collection, storage, use and disclosure of your personal information as described below.  As required by the Children’s Online Privacy Protection Act (“COPPA”), we also provide additional privacy protections for children users who are under the age of 13.  Our Children’s Privacy Policy can also be found at the end of this Privacy Policy.  

I. Information We Collect

In order to help create a safe and effective online experience for all users on our Site, we will collect user-submitted, personally identifiable information when you use the site. Such information may include your name, password, zip code, email address, and phone number for communication purposes. Information may be submitted to the TUTORCARE website or via phone or email when communicating with a TUTORCARE Customer Service Team or TUTORCARE Representative. 

Registration:  You can browse our Site without telling us who you are or revealing any personal information.  However, in order to use any interactive features of the Site, you must first register and provide personally identifiable information (such as your name, email address, password, birth date, home address, phone number and parent's information).  We may also collect anonymous demographic information, which is not unique to you, such as your age and gender. We may gather additional personal or non-personal information in the future.  If you apply to become a Contributor on the Site, you will be required to provide us with your social security number and/or taxpayer ID number.

Purchase/Sale Transactions:  If you purchase any Tutorials or Services on the site, we collect billing and credit card information. This information is used to complete the purchase transaction  Our online purchase forms will request financial information (such as your name, credit card number with expiration date and a billing address or bank account information).  We’ll note the type of services or products ordered or purchased, as well as the date of the order or purchase.

Usage History, Interactive Features and Public Forums:  We may also collect additional personal information when you use some features on the site and when you correspond with our customer service representatives by phone, mail or e-mail.  If you use the interactive features on the site, you should be aware that any personally identifiable information you submit in the body of your messages can be read, collected and used by other users of these forums. Users could then send you unsolicited messages.  We are not responsible for the personally identifiable information you choose to submit in these forums.  We reserve the right to terminate the accounts of any registered users who use the TUTORCARE messaging system in a manner inconsistent with the Terms.

We may also occasionally supplement the personal information you submitted to us and the information we collected through technology with information from third party sources.

If you would like to become contributor on our site, we require that you go through an application process. As part of that application process, we will use a third party service to conduct background checks as permitted by law.

II. Use of Information

TUTORCARE collects and uses your personal information to operate its website(s) and deliver the services you have requested.

We will also communicate with you by email in response to your inquiries, to provide any assistance you request, to manage your Account (such as billing issues), and to send you operation-related announcements.

III. Gathering, Use and Disclosure of Non-Personally Identifying Information

We reserve the right to collect Non-Personally Identifying Information and Personally Identifying Information from you. TUTORCARE also shares a minimum amount of information between Contributors (tutors) and Purchasers (students or parents) in order to facilitate the arrangement of tutoring sessions. TUTORCARE does not disclose or sell your personally identifiable information without your consent.

“Non–Personally Identifying Information" is information that, without the aid of additional information, cannot be directly associated with a specific person or entity.

"Personally Identifying Information” is information such as a name or email address thatcan itself be directly associated with a specific person or entity.

Use of Cookies: We use cookies to help you personalize your online experience with TUTORCARE. A cookie is a text file that is placed on your hard drive by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. TUTORCARE uses cookies to better customize your experience on the site based on user attributes like your location and account preferences. One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize TUTORCARE pages or register with the TUTORCARE site or services, a cookie helps TUTORCARE to recall your specific information on subsequent visits. When you return to the same TUTORCARE page, the information you previously provided can be retrieved, so you can easily use the TUTORCARE features that you customized. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the TUTORCARE services or websites you visit.

Third Parties’ Use of Web Beacons and Web Cookies: This Site may include third-party advertising, links to other sites, and other content from third party businesses. The content posted by these parties will be reasonably identifiable as coming from a third party. These third-party sites, businesses, and advertisers, or advertising companies working on their behalf, sometimes use web beacons (also known as action tags or single-pixel gifs) and web cookies to measure the effectiveness of their ads, personalize or optimize advertising content and track users who link from their respective sites to this site. However, this third party technology does not permit them to access your Personal Information.

We do not have access to or control over web beacons or Web Cookies that these third parties may use. The information practices of these advertisers and third-party websites or businesses are not covered by this Privacy Policy but are covered by their respective privacy policies.

Use of Non-Personally Identifying Information: We analyze Non–Personally Identifying Information gathered from users of this site to help us better understand how this site is being used. TUTORCARE may keep track of the websites and pages our users visit within TUTORCARE in order to determine which TUTORCARE services are the most popular. This data is used to deliver customized content and advertising within TUTORCARE to customers whose behavior indicates that they are interested in a particular subject area.

Disclosure of Non-Personally-Identifying Information: From time to time, we may also release the Non–Personally Identifying Information gathered from site users to publish a report on trends in the usage of this site and help us improve our service. 

IV. Gathering, Use and Disclosure of Personally-Identifying Information

Personal information about our users is considered an important asset of our business and service. We are not in the business of selling or renting your personal information to third parties without your consent.

If you are a Contributor, we will not share your social security number and/or taxpayer ID number (which you are required to provide as part of the application process to become a contributor) with any third parties except as necessary to perform background checks with third party sources, to disburse funds for Contributions or Services you post or provide or as otherwise noted below.

TUTORCARE Support Team and Third Party Providers: We employ other companies and individuals to perform functions on our behalf.  Examples include fraud investigations, processing credit card payments, background screening, providing marketing assistance and providing search results and links (including paid listings and links).   These companies are allowed to gather and use your personal information only as needed to perform their functions or as required by law.

Parents:  If you are the Parent or Guardian who created the TUTORCARE Account for your child who is under the age of 13, upon your request we will share your child's activities and communications that are stored in our site with you. TUTORCARE does not knowingly collect personal information from children under the age of 13.  If you are the parent or legal guardian of children under the age of 13 who may have provided information to us without your knowledge or consent, please contact us to have this information removed. All contacts, including tutoring sessions, between a Contributor ("tutor") and any minor either in online or in-home settings should only take place under supervision.

Legal Disclaimer:  In an effort to respect your privacy and our ability to keep the site safe and secure, we reserve the right to disclose your personal information, without notice, only if required to do so by law or when we believe such release is appropriate to: (a) comply with the law (including tax reporting obligations), or to respond to legal requirements; (b) enforce or apply our Terms and other policies; and (c) protect and defend the rights, property, or safety of TUTORCARE, our users or others when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.  TUTORCARE does not sell, rent or lease its customers' information to third parties.

V. Communication Preferences, Opt-In, and Opt-Out Choices

By accepting our Terms and Conditions, your account will Opt-in to marketing e-mails. You have a choice to give or withhold your consent to use your personal information for marketing purposes and to send you marketing e-mails.

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from TUTORCARE by contacting our TUTORCARE Customer Service Team at

If you choose to “opt out,” it may take up to ten (10) days after you “opt out” for your election to be fully effective.

Please remember to help keep the site secure by never sharing your username or password. If you think your password may have been compromised, please change it immediately or contact TUTORCARE for additional assistance.

The security and confidentiality of your personal information is extremely important to us.  Your information is stored on our servers located in the United States. We use technical (i.e., Global Sign Secure Sockets Layer (SSL) software for encryption, passwords, physical security, etc.) administrative measures to protect your personal information against unauthorized access and disclosure of your personal information.

Please understand that despite our best efforts, no method of transmission over the Internet is 100% secure. While we try our hardest to use acceptable methods to protect your personal information, we cannot guarantee absolute security. Therefore, it is extremely important and necessary for you to protect yourself against any unauthorized access to your computer or your account. 

VIII. Accessing, Reviewing, Changing, and Deleting Your Account Information

You can see, review and change most of your personal information online through your account settings.  You must promptly update your personal information if it changes or is inaccurate. You may also deactivate your account by contacting the TUTORCARE Customer Service Team.  Upon your request, we will close your account and remove your personal information from the site as soon as reasonably possible, based on your account activity and in accordance with applicable law.  We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms, and take other actions otherwise permitted by law.

IX. Links to Other Sites and Third Party Advertisers

We do not provide any personally identifiable information to third-party websites or to advertisers and Internet advertising companies. This Privacy Policy will not apply to your personally identifiable information collected on that third party’s website.  We are not responsible for the privacy practices of such third parties or network advertisers and you must read the privacy policy posted on their respective websites to see how your personally identifiable information will be handled. 

X. Privacy Policy Changes

TUTORCARE reserves the right to change this Privacy Policy, from time to time, due to modifications to the site’s features and functionality. We will post any changes here and indicate the new effective date of the Privacy Policy at the top of the document. We encourage you to review the Privacy Policy for any updates while you are an active user of the site.

Children’s Privacy Policy

The Children’s Privacy Policy is designed to describe TUTORCARE’s privacy policies and principles with respect to children under the age of 13.  The Children’s Online Privacy Protection Act (“COPPA”) requires that we inform Parents about how we collect, use and disclose personal information from children under 13 years of age and that we obtain the consent of parents in order for children to use certain features of our site.

Please read this policy carefully as it explains our practices regarding the collection, use and disclosure of Personal Information from children who register on the site and describes a parent’s or guardian’s ability to limit the collection and use of data collected from their Children.
This privacy policy (“Children’s Privacy Policy”) is also incorporated into TUTORCARE's Terms of Use. 

I. Collection of Personally Identifiable Information About Children

Children can visit our Site and view content without giving any personal information to us.  However, to use the services available on the Site, children will need to be a registered user.

We are required by law to obtain verifiable parental consent in order to collect, store, use or disclose Personal Information from children. By giving consent, a parent (a) agrees that the child’s online activities are subject to the Terms of Use, including without limitation this Children’s Privacy Policy, and (b) consents to our storage, use and disclosure of Personal Information collected from the child as described in this Children’s Privacy Policy. Once such consent is received, the child may then access certain features and services available on our Site as a registered user

Like other users of the site, we will store all of the child’s emails and communications through the site after his or her account is activated. If the parent requests access to the child’s e-mails and activities on the site, it will take us 1-2 weeks before sending him or her all the recorded communications and activities of the child. If the parent requests recording of all online tutoring session conducted through the site between the child and the tutor or contributor, the parent must notify the Tutor or the TUTORCARE Customer Service Team at 1 week before the tutoring session starts. There will be a fee associated with recording the online tutoring session.

According to the law, all sites that allow access of children under 13 are prohibited from asking the child to provide more personal information than is reasonably necessary. TUTORCARE does not encourage or force children to provide more information than is reasonably necessary. 

II. Information the Child Provides

On the site, children may store other personal information, participate in surveys and polls, subscribe to a service or purchase a contribution.  We may need or request certain types of personally identifiable information (i.e. information that can directly identify a child or indicate where a child might be contacted, or information associated with the foregoing “Personal Information”) and collect it in connection with these various activities and offerings.  We collect the following Personal Information, if voluntarily provided by a child: name, address, e-mail address, telephone number, fax number, parent’s email address, age, date of birth, sex, grade level, wish list information and credit card information.  We do not consider demographic information about a child (such as age, date of birth, sex, grade level, products purchased and indications of a child’s interests) to be personal information unless it is associated with personal information that permits identification of a specific child.

We will also use cookies to help to enhance and personalize your child’s experience with the Site. Cookies will be used to “remember” your child and his or her particular preferences in order to customize the child’s experience on the site.  We may use anonymous information about the use of the Site for research purposes and to improve our site.  We will not sell any information collected by cookies or use the information for commerce-related purposes.

III. Disclosure of Personally Identifiable Information About Children

As a matter of policy, we do not disclose personally identifiable information about children to third parties.
However, we may also disclose such information to third parties to the extent reasonably necessary to: 

  • protect the security and integrity of our sites; 
  • enforce our Terms and take precautions against liability; 
  • to respond to judicial process; 
  • to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety;
  • additionally, in the event that all or substantially all of the assets relating to the site are transferred or sold to another entity, personally identifiable information submitted to us may be transferred to the acquiring entity.

To protect the child’s personal information from disclosure to third parties while participating in certain interactive features of the site, we have created some additional safeguards.  The child’s real e-mail address will never be publicly disclosed or used by other users on the site. The child will create his or her username. Therefore, his or her full name will not be exposed to any users on the Site, unless child or parent of the child agrees to do so. Therefore, Parents take full responsibility for monitoring their child's activities and communications with any users on the Site.

IV. Notification and Obtaining Consent for Collection of Personally Identifiable Information

As part of the registration process, when a parent creates an account for a child, we will provide notification by displaying this Children’s Privacy Policy (along with the Terms) in order to obtain his or her express consent to our collection of personally identifiable information about their children.

V. Right to Access, Change or Delete Personally Identifiable Information About Children

Each Parent will have the option to view all emails, discussions or content trails of the child’s activities on the Site. This feature allows the parent to monitor the child’s activities on the site. 
Parents may review the personally identifiable information provided about their children, change how we use it, refuse to permit us to collect further personally identifiable information from their children and request that the personally identifiable information we collected be deleted from our records or changed.  Parents may contact our Customer Service department via e-mail at to do so.  Please include the child’s email address in the e-mail so that we can better assist you with your inquiry or request.

VI. Notification of Changes to Children’s Privacy Policy

Please see our Terms for details on how we will provide notice of changes in the Privacy Policy, including the Children’s Privacy Policy. In addition to what is stated in the Terms, we will provide parents notice by e-mail of any material changes in the way we intend to collect, use and/or share children’s personal information.  Parents should update their personal information to provide us current e-mail addresses. We will apply material changes in our Children’s Privacy Policy only in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.
